She has filed a lawsuit against Lee on Monday, claiming he assaulted her in his room at the Hyatt Regency during the weekend of April 21-23 a year ago, during the Chicago Comic & Entertainment Expo, which he attended.
Carballo is seeking a judgment "in excess of $50,000, plus an award of punitive damages, and attorneys" fees and costs as permitted under the statute'.
Now, Maria Carballo, a massage therapist based in Cook County, has filed a complaint against Lee, and his assistant, Mac Anderson for five counts, including assault, battery, violation of the Illinois Gender Violence Act, emotional distress and civil conspiracy.
Lee again reacted the same way when she massaged his thighs, she said.
Lee, 95, denied the allegations through his attorney Jonathan Freund, who told the Chicago Tribune that his client was shocked by the allegations. He added, "He is a high-profile public figure and I think it's a shakedown".
Naked, the nonagenarian hopped up from the massage table enraged, demanding the session continue, claims Carballo. I am not. After seeing other women fight to be treated with dignity and respect, I decided, "Me too".
Carballo also said that when her employer asked her to perform another massage on Stan Lee, she initially refused, but claimed that he said he was "sorry", so she returned to perform another massage.
When she began to therapeutic massage his thighs Lee began to moan and groan, the lawsuit alleges, at which level Carbello lower the therapeutic massage quick and agreed to be paid for one hour as an alternative of two.
A representative for Lee did not respond to requests for comment.
The therapist said that when Lee started moaning again, she once again ended the session.
"He is rich and famous".
The suit reads: "Lee grabbed Plaintiff's foot and moved it against his penis and scrotum". Before she got on the elevator, Lee's assistant allegedly gave her a big tip in cash.
"I am still nervous and afraid, but not as much as I was before because I have other people helping me".
Lee's business partner, Keya Morgan, told TMZ that Lee is "completely harmless" and "100 percent innocent".
